Notice to Vacate on or before the Termination date 09 June 2024
Darcy the tenant had numerous issues with the then Real Estate Agent.
He was the sole resident in a rental flat in the quiet suburbs of Glen-Huntly Vic., for over 20 years, paying his rent on or before the due date, and keeps the property clean.
The property inspection in 2023 was unlike the usual, the men from the Real Estate Agents were tapping on the walls to check structural condition, Darcy emailed the property manager of the then Real Estate Agents and inquired if the property owner is considering selling the property, she said she does not know.
Had the propery Agent found out from the owner, Darcy would have requested the Agent to thank the property owner for the 20 yrs of accommodation, and moved to another rental property.
Instead, the property Agent, sends a registered letter "Notice To Vacate", (that was left on the front door, reminiscent of Darcy’s "Eviction Notice" as far back in May 1988 in Essendon, referred to on this website - Page 1).
Darcy vacated the premises well before the termination date of 9 June 2024, to another rental accommodation. And sent a thank you letter to the property owner for the 20-year accommodation of her property.
There seems to be something very wrong in this "Notice To Vacate" given by this Real Estate Agent, who represents a very reputable Real Estate Business, Australia wide, of over a 100 years.
Quote- Reason for Notice;
I am giving you this Notice for the following reasons:
Section 91ZZB Premises are being sold.
91ZZB(1): The premises are to be sold or offered for sale with vacant possession immediately after the termination.
The renter provider would like to sell the property in vacant possession. The renter knows that he/she is to lease out for 6 months after possession Unquote
Perhaps we can agree, that the premises are to be SOLD or offered for sale with vacant possession immediately after the termination date 09 June 2024. This is the direct contradiction; the property is to LEASE out for 6 Months, after possession 09 June 2024.
The Renter is Darcy, of this rental premises for over 20 years, and he, is not aware that the premises are to be leased out for 6 Months after possession.
